What I don't understand (maybe someone could enlighten me) is why he was arrested on the 'SUSPICION' of drink driving.

Thankfully, I have never been breathalised but my understanding from watching reality TV documentaries, the suspect is breathalised on the spot and if positive, arrested and taken to the local nick where a second and more accurate breath test is done. If that proves positive, the person is charged.

So, why the SUSPICION ?  He was either over the limit or he was not. Huh

The reason will probably be that the CPS are considering other charges and want to make all the charges at the same time.

If this was just a case of driving under the influence you are quite right with your timeline.  The person would be breathalysed on the spot and if positive, arrested and taken to the local station where a second and more accurate breath test is done and the person would normally be charged at that point, however there is no need for the person to actually be charged at that point.  

If the CPS are looking at other charges related to speeding and if the rumour mill is true and the speeds involved were around the 110MPH mark, then they almost certainly will be.  

Whether that is in the form of a simple speeding offence or a more serious offence of Careless Driving or even Dangerous Driving remains to be seen and very much depends on the individual circumstances.

If the "reported" allegations are accurate, he is probably looking at best at a ban for each offence and a fine, at the very worst, though extremely unlikely, if found guilty of Dangerous Driving, the maximum sentence is up to 2 years imprisonment and an unlimited fine. (The maximum for Careless being 6 moths and a fine).

My biggest concern is that, he was reported to the police by a member of the public and I just hope he did not do something dangerous, that caused the member of the public to contact the police as that would make a dangerous driving charge, if provable, a bit more likely.  All speculation and guess work at the moment though, lets hope he is innocent and a big misunderstanding.

Thanks for the explanation Salop.

However, it still doesn't explain the SUSPICION of drink driving. When tested at the roadside he would have been either positive or negative with the same at the follow up test in the nick so how can it be suspicion.

He could of course have refused to take a test or, he wasn't actually stopped at the time, only reported by a member of the public and the rozzers didn't get to him wherever he was for some hours which, give the elapsed time, a breathtest may have been pointless. (Bit like our last two games !) Maybe it would then involve a bloodtest to establish a longer time-line based on the level of sherbets found in his blood.

They have to say "suspicion of committing an offence" until the person is actually charged with that offence. They may or may not have the evidence as in the breath or blood test results, but until they actually go through the charge process, the person is still only suspected of carrying out the offence. Sorry I should have explained that a bit clearer.

talking to an ex policeman with 30 years service including traffic.

its suspicion of drink driving because the legal limit is 35 if he blew between 35 and 50 he has the right to request a blood sample, depending on how long it took the doctor to come and take the sample could effect the outcome, especially with him being a very fit person.

a blood sample takes about 6 weeks to come back, which would fit in with the time scales, 22nd October to early December

chances are that it will come back negative, but obviously he still has the speeding offence.
